Bank of America s handling of federal unemployment benefits is under challenge by an increasing number of claimants from throughout the country. In more than two class action suits, a new filing from California claims that the bank is failing to make it correct for the millions who have been frozen out of the money they are entitled to by the bank. The bank maintains it has done everything it can to give its unemployed workers fair notice and consideration of their cases for unemployment benefits.
Yet more class action lawsuit challenging the bank's handling of disability benefits fraud has been filed. In one such case, an unemployed worker claimed her benefits were illegally denied when she filled out an application at a local branch of Bank of America with a local agent. She later found out the application she had filled out contained errors which, in all probability, made her case improper.
Another claim being considered involves the wrongful denial of disability benefits to claimants who rely on disability payments from their union, employer or other sources, such as food stamps. This is part of a growing class of mortgage fraud currently under investigation by the United States attorney's office. Such fraud is on the rise as banks routinely deceive their homeowners in order to secure larger profits for their lenders. In one case cited in a recent article, Bank of America was revealed to have instructed foreclosing homeowners to falsify information on their applications so they could secure a higher interest rate, leading to a loss of thousands of dollars of income from the victims.
Another class action lawsuit being considered by an attorney representing claimants who lost their jobs at Bank of America in the Santa Monica area involves wrongful termination. This case is being handled in California by the Law Center for Worker Rights. The center is part of a nationwide network of pro-worker rights groups, including the Southern Poverty Law Center and the National Employment Law Foundation. According to the group, there has been a disturbing increase in the number of firings and wage garnishments in California. No legitimate employer should be allowed to take advantage of their workers, or take any steps to limit their compensation.
Another case involves the failure of Bank of America to provide sufficient unemployment benefits to claimants who were set to receive unemployment compensation Direct Deposits. The state of California is well acquainted with Bank of America's disregard for its workers' rights. There have been widespread reports of foreclosures across the nation's largest financial institutions, including Bank of America, which recently received a foreclosure notice from the US Department of Justice. In addition, it was discovered that some of these employees were permitted to use their payroll credits for personal expenses. One particularly disturbing incident described in the News Herald report occurred when an employee's son suffered from cancer. He had been receiving regular direct deposit benefits but, after his diagnosis, was told that the bank would no longer be making such payments.
The bottom line is that there are certainly abuses of Bank of America's unemployment system, both in regard to unemployment insurance claims and for collecting payroll taxes from bank customers. When it comes to protecting American workers, it is imperative that our tax systems are strictly followed. When it comes to the tax incentives for workers who accept Bank of America jobs, many of these workers may not even be aware of the employment opportunities available to them through this company. Such employees may fall into the category of being a “costumer” of Bank of America who, through no fault of their own, have been conned.
