The priority date is one of the most used United States federal holidays in many areas of the country. Because it falls on a Saturday, it typically works out well for many people who want to go to be with loved ones on this day. But how does the government move forward with regards to the next official priority date? Is there something that needs to be done and how can the government tell when it is time to move the date forward?
The government officially allows many categories of people to file for extensions on the calendar year. This can include many things from those who have moved and are changing their addresses to those who are simply interested in learning more about getting an extension. However, the calendar year cannot move forward without the approval of the Secretary of State. There are many deadlines involved, and they do not always work quickly. In some cases, you might have to wait as long as eighteen months to get your extension application approved.
The immediate concern for many who receive a priority date change is how to keep working if there are major changes coming down the road. One possibility is to simply follow the new deadlines that go into effect. For example, those who received a three-month extension will need to apply for another extension no later than three months after the original application was filed. This is to ensure that the applicant is still qualified for the job loss compensation. In addition, it is important to keep in mind that some legal teams will not work on extensions during certain periods of time.
If an individual has received a six-month extension and then the renewal process starts six months after the original application was filed, they will need to begin the premium processing. Premium processing times vary by the State. The actual date of renewal could be anywhere from two weeks to six months after the start of the premium process. Depending on when the State department receives the paperwork, they will begin the six-month period immediately or let it run until the date is reached.
It should be noted that when an individual is approved for a six month extension they are still subject to the same six month premium processing timeline. If there is a change to the State Department rules or to the calendar, a person may need to contact the processing office to find out if their six month premium processing timeframe has been changed. Some States have an emergency rule in place. This means that the State department will revoke the application at any time due to an unforeseen emergency that has occurred.
If the application was approved and then the six months ended, the applicant still needs to wait for the appeal to be completed. The appeal process can take up to a year. However, the applicant may hire an attorney or an agent who will seek to have the emergency stay lifted during the appeal process. After the appeal is completed, the applicant will then receive notification that their premium is authorized and their HVAC unit will be deemed operational. However, if the emergency stays until the end of the year, the applicant will be required to pay for reconnection.
It is imperative that if a State department denies an application, the applicant should know why the denied application was made. If the reason is found to be valid, the State department may reconsider the decision. However, if the State department decides that the application was denied based on an improper reason, then they must provide an explanation as to why the decision was wrong.
For those who are interested in purchasing an HVAC system, it will be beneficial to understand how the priorities date may impact the process. One of the reasons the priority date may be important to an HVAC company is if the company is working with a large number of customers who purchase their HVAC units annually. If the unit is not purchased on the primary day of the month that the unit is needed, it will not be able to be sold on the emergency priority date. Additionally, in some cases, if the emergency sale date is not reached and an HVAC unit is already sold to a customer, the State department will request the sale from another provider. If this happens, the State department can request that the provider return the money that was paid for the emergency service.
