Recently, Employment-based green card applications – EB, EB3, were really waiting, expecting for some EB, or EB3 Priority dates to be approved with October 20th, 2021 Visa bulletin date. For approved non-immigrant visa applicants whose work permits are already obtainable at that time, or who are inadmissible due to the result of an immigrant classification determination, the E-aca date becomes current. This is also the same date that the P visa would become effective.

In addition, there are two employment-based final action dates: the “published” veronika date and the “scheduled” veronika date. The published veronika date refers to the final date for LPR and PR-1 status applications to become published after the initial public announcement of their approval. The scheduled veronika date is the actual employment-based deadline for visa interviews and application collections. Both announcements are made by USCIS. If neither date is reached by either agency, then the third, final priority date for green card status applications becomes active.

The third step that is taken after receiving an E-aca notification is the “employment eligibility verification”. If you are an eligible immigrant with work permit, you will need to go through a fairly long process in order to verify that you meet the above-mentioned three-step approval threshold. The three-step verification process entails checking the date of birth, social security number, work permits and other documents that are required for proving your identity and eligibility for work-authorization. You have to do this regardless of whether you received a notification or not. The reason why you need to do it at this point is to avoid being denied for a green card on the grounds of an incorrect birth date or even on the basis of a social security number that is not yours.

Two of the three steps listed above have to be completed by either the applicant (if they received an E-aca notification) or the recipient (if they received a notice). However, if either one of these steps are not completed, it becomes a priority date for visa interviews. An applicant cannot be granted a green card before they are interviewed. Once you have been given an interview, you then have to decide whether or not you want to proceed with the application process. It is important that you submit all documentary evidence that you require to support your claim before your interview. Even if you were given an approval for submitting evidence on the day of the approval, it does not mean that the evidence is admissible in a court of law.

Finally, it is important that you receive an E-aca notice from the USCIS by the last month of June. This is a vital step because it indicates that you have met the three-step verification process. If you were granted a green card on the previous June deadline date, you cannot qualify again on the current June priority date. Therefore, it is vital that you submit all documentation by the required deadline. Following these steps ensures that you will have the best chances of receiving an E-aca notice and receiving an immigrant visa.
