If you are a United States Citizen, you have probably either been assigned an eb3 priority date, or an eb3 visa. An eb3 visa is usually issued when you or your spouse or any dependent to apply for adjustment to the status of an individual or family under the immigration laws. The term applies specifically to those individuals who are United States citizens, regardless of their age. However, those applying for green card benefits may also be issued an eb3 visa. If you are assigned an eb3 visa, you may be eligible to apply for adjustment to social security number status.
Two deadlines are used for filing the green card application. The first deadline is for the initial application filing period and the second for the completion of the adjustment application. Both of these dates are specified in the immigration law, as section 1257. Both of these deadlines can be adjusted, by the filing of an appropriate certificate of adjustment.
The most common procedure to adjust the green-card status of an individual is to file an application for adjustment of status with the Department of Homeland Security. You may be assigned a eb3 priority date, but if you do not file the appropriate forms on time, your application will be denied. To make sure that you file the forms on time, you must submit an I-140, accompanied by an appropriate fee. This I-140 is a checklist of all necessary documents to support your claim for adjustment of status.
The I-140 is available at any visa office or online at a variety of vendors. It consists of a nine-page checklist, describing various aspects of your employment history. It requests three pages of information from the employee, such as employer or employee identification number, passport or birth certificate. It asks about length of employment, permanent residence, work location, period of confinement, applicable taxes, and any other conditions that may affect eligibility for adjustment of status.
If you are granted an eb2 priority date, then your I-140 is sent to the Department of Homeland Security. At this point, it is necessary to file an Adjustment Application, which is typically filed along with the I-140. Once filed, you will receive a final action chart detailing the types of adjustments available to you. The chart indicates whether you can request an increase in waiting period, a decrease of waiting period, reinstatement application fee, or immediate receipt of status.
If you received a final action notice, you must abide by the terms set forth in the notification. If you wish to request an immediate upgrade of your status to respected visitor or non-immigrant alien status, you must file a request for adjustment. If you were given an eb3 priority date, it does not mean that you cannot do so. In fact, there are numerous ways for an individual to increase their status to immigrant or temporary visitor immediately. If you would rather decline the chance at improving your status, however, you still have several months (up to three months) to file your final I-140 against your original visa.
If your job or family life demands a little bit of time to adjust to your new status, you should be aware that the deadline for most people receiving an eb3 visa bulletin is on the last day of October. If you have not received a notice and you are interested in applying for immigration benefits, you should begin preparing the necessary documents as soon as possible. You will want to start the process by determining what is owed to you as a beneficiary of the child or dependent. If your relative or spouse is receiving monthly benefits, they are generally entitled to an immediate increase of time. In cases where dependents are not receiving monthly benefits, you will want to file for a claim for timely application.
If you were given an eb3 priority date and are not receiving a green card within the specified time period, the important question to ask your employer is whether they will honor their promise and make it possible for you to apply for immigration. Some employers will make it possible for you to submit your paperwork as early as October twenty first, but this is not always the case.
